Auto Buying Consulting LLC (hereafter “Auto Buying Consulting”) is a service based company located at 13480 Virgo Court, Littleton, Colorado, 80124. Auto Buying Consulting is a consulting service business with intricate knowledge of the automotive sales industry, as well as strong relationships with numerous auto dealerships and other automotive related entities. Additionally, Auto Buying Consulting has extensive experience within the auto industry, which strategically positions Auto Buying Consulting to negotiate auto purchase agreements at lower pricing than the average consumer.

Services (hereafter “Services”) offered by Auto Buying Consulting include, but may not be limited to, the following:

Auto Buying Consulting will provide a needs analysis to identify what the Client (hereafter “Client”) is seeking in a new vehicle. Initial information Auto Buying Consulting will request from the Client includes: Vehicle Type, Make, Model, Features, Pricing and Payments. Auto Buying Consulting will leverage this information to negotiate the best Purchase Agreement (hereafter “Purchase Agreement”), from applicable auto dealerships. Auto Buying Consulting will present the best Purchase Agreement, or Purchase Agreements, to the Client.

Upon approval of the Purchase Agreement by the Client, Auto Buying Consulting will work directly with the applicable auto dealership to finalize all arrangements related to the Purchase Closing (hereafter “Closing”). This will include having the vehicle detailed and prepped for the Client, as well as coordinating the signing of all paperwork, and delivery to the Client (when delivery service is available through the Dealership).

CLIENT’S RESPONSIBILITY

The Client acknowledges that it is the Client’s responsibility to review all forms and documents, provided by Auto Buying Consulting, to ensure that the forms and documents meet the Client’s specifications and accurately reflect the Client’s requirements. It is also the Client’s responsibility to see that forms and documents are correctly and promptly executed, when necessary, and to retain copies of these forms and documents. The Client also assumes liability for all charges incurred as a result of any/all services performed by Auto Buying Consulting, on behalf of the Client, or at the direction of the Client. The Client is responsible for full payment of Auto Buying Consulting’s fees before any work shall commence on the Client’s behalf.

HOLD HARMLESS

The Client agrees to indemnify and hold harmless Auto Buying Consulting, its assigns, employees or agents, from all liability related to, or arising from, any and all inaccuracies or incomplete information provided or, as the case may be, not provided, by the Client, concerning any of Auto Buying Consulting’s Services.

NO GUARANTEES

Auto Buying Consulting does not guarantee a particular result, or outcome, from the Client’s utilization of any of Auto Buying Consulting’s Services. The Client hereby acknowledges that the Client understands that no promises have been made by Auto Buying Consulting as to what result can, or will, be achieved by the use of any of Auto Buying Consulting’s Services. Auto Buying Consulting’s comments about the outcome of the Client’s use of Auto Buying Consulting’s Services are expressions of opinion only.

Auto Buying Consulting, LLC: LIABILITY

Auto Buying Consulting, its agents, employees or representatives specifically disclaim any warranty, either express or implied, including the implied warranties of merchantability and fitness for purpose. Under no circumstances are Auto Buying Consulting, its advisors, agents, employees or representatives liable or responsible for any damage or inconvenience caused, or alleged to be caused, by the use of Auto Buying Consulting’s Services (hereafter “Services”). Auto Buying Consulting does not assume any legal, financial or other liability or responsibility for the accuracy, completeness or usefulness of any official forms or documents, prepared by any third party, and signed by the Client. Any forms or documents prepared by any third party, and signed by the Client, are subject to review by Auto Buying Consulting, prior to the Client signing such forms or documents, and Auto Buying Consulting will not be liable for any fees associated with subsequent corrections or other revisions for forms and documents which are not prepared and/or reviewed by Auto Buying Consulting. Except in the case of Auto Buying Consulting’s proven negligence or willful misconduct, in either of which events Auto Buying Consulting’s liability (in the aggregate) shall not exceed $5,000, Auto Buying Consulting’s entire liability and the Client’s exclusive remedy for damages due to the performance or non-performance of Auto Buying Consulting, for any cause whatsoever, regardless of the form of action, whether in contract or in tort, shall be limited to the refund of the charges specifically related to the performance or non-performance of the direction of the Client. Under no circumstance does Auto Buying Consulting assume any liability whatsoever to any party other than the Client for the Client’s use of Auto Buying Consulting’s Services, and the Client agrees to indemnify Auto Buying Consulting against any claims brought by such parties. The Client is prohibited from assigning any cause of action or remedy to any third party and is further prohibited from encouraging any third party from bringing any cause of action against Auto Buying Consulting. Auto Buying Consulting is diligent and takes reasonable measures to provide accurate information and services. However, Auto Buying Consulting cannot warrant or guarantee that its services are comprehensive, complete, or without error and Auto Buying Consulting is not an insurer with regard to the services performed. In order to obtain Auto Buying Consulting’s services for the stated charges, the Client agrees to assume the risk for any and all liabilities disclaimed by Auto Buying Consulting and all damages that exceed any limited remedies provided herein. Auto Buying Consulting shall not be liable to the Client or any other third party for any direct, indirect, special consequential or incidental damages.

ELECTRONIC SIGNATURE  

By typing your electronic signature in the form below and clicking the "Submit" button, you hereby; (i) agree that you have read, understand, and agree to be bound by, Auto Buying Consulting’s Terms and Conditions; (ii) have been advised that Auto Buying Consulting’s Terms and Conditions and your agreement to be bound by Auto Buying Consulting’s Terms and Conditions constitutes a legally binding contract under the laws of the State of Colorado; (iii) expressly authorize Auto Buying Consulting to charge your credit/debit card a one-time consulting fee, non-refundable.
